Limited Hardware Warranty and Support Terms
Thank you for choosing TIBURN.
The warranties provided by Shenzhen Tiburn Technology Co., Ltd. ("TIBURN") in this Limited Hardware Warranty apply only to Hardware Products that you purchase for your own use, and not for resale.
A "Hardware Product" refers to a computing device designed to perform specific functions with limited configuration options. These products are sold by TIBURN to run the dedicated TIBURN software provided with them.
Please note that this Statement of Limited Warranty does not affect any statutory rights you may have as a consumer, which cannot be waived or limited by contract.
LIMITED HARDWARE WARRANTY
Tiburn warrants that the hardware components of its products are free from material defects in design, materials, and workmanship. Under normal use and conditions, the hardware will function according to the provided documentation for a period of twelve (12) months from the date the product is delivered to you.
Your Remedies
If a hardware component is confirmed to be defective during the warranty period, Tiburn will, at its option:
- Repair the component using new or refurbished parts
- Replace the component with a functionally equivalent product
- Refund the product's purchase price
This constitutes your exclusive remedy for hardware defects.
Important Details
- Replacement parts are refurbished to meet or exceed new product specifications
- All replacement parts are covered for the remainder of the original warranty period
- Hardware failures within the first 30 days after delivery will be addressed with new replacement parts or units
- Replaced defective components become Tiburn's property
- Repaired components remain your property
Support After Warranty
After the warranty period expires, Return Material Authorization (RMA) services may be available under an active Tiburn support agreement (separate from this warranty).
This warranty gives you specific legal rights, and you may have other rights that vary by state.
EXCLUSIONS
The foregoing warranties and remedies shall not apply to any Hardware Products that have been damaged or rendered unserviceable as a result of any of the following causes:
- Improper or inadequate maintenance performed by anyone other than Tiburn or its authorized service providers;
- Use of software or interfaces not supplied or approved by Tiburn;
- Modifications, alterations, or repairs made by personnel not certified by Tiburn or its authorized agents;
- Unreasonable refusal to implement engineering change notices recommended by Tiburn;
- Negligent handling or operation by any party other than Tiburn or its authorized representatives;
- Misuse, abuse, accident, power irregularities, theft, vandalism, fire, water damage, or other fortuitous events;
- Operation or storage outside the specified environmental conditions for the Hardware Products;
- Unauthorized alteration or integration with other systems, equipment, or devices without Tiburn's prior approval;
- Any use that deviates from the instructions contained in the product's user manual.
The warranty period will not be extended if Tiburn repairs or replaces a product or component. Tiburn reserves the right to modify the terms of its limited hardware warranties at its discretion, provided that any changes shall not apply retroactively.
HARDWARE RETURN PROCEDURES
If your Tiburn product or any of its components doesn't work properly during the warranty period, and we can confirm the issue, we will provide a solution. Depending on the product and situation, this will typically involve repairing your unit or replacing it with a refurbished product that meets or exceeds original specifications.
To start a warranty claim, please follow these steps:
- Contact Support: Get in touch with our Technical Assistance Center (TAC) to open a service request. Our team will help you troubleshoot the problem.
- Get an RMA: If we determine that your product needs service, we will issue a Return Material Authorization (RMA) number. You must have this number before sending anything back to us.
- Product Registration: For faster service, please register your product in your Tiburn User Center account. If you haven't registered, you may need to provide a copy of your original sales receipt as proof of purchase and warranty coverage. The product's serial number will be required in all cases.
Shipping Costs:
- You are responsible for the cost of shipping the defective product to Tiburn.
- Tiburn will pay for the shipping cost to send the repaired or replacement unit back to you.
Please note: If we find that the reported problem is not covered by the warranty (for example, if it was caused by accidental damage or the warranty period has expired), you will be responsible for all costs associated with the evaluation and return shipping.
This warranty gives you specific legal rights, and you may have other rights that vary from state to state.
HARDWARE REPLACEMENT PROCEDURES
If you have a hardware issue, Tiburn will first work with you by phone or online to diagnose and try to resolve the problem.
If we determine the issue is caused by a faulty hardware component, our Technical Assistance Center (TAC) will initiate a Return Merchandise Authorization (RMA). We will then either replace the specific faulty part (like a Power Supply or display) or the entire unit.
Standard Warranty Replacement:
For this service, you will need to ship the faulty unit to a Tiburn-designated location and provide the courier name and tracking number to our TAC. After we receive the faulty unit, we will use commercially reasonable efforts to ship your replacement hardware within seven (7) business days. Actual delivery times will vary based on your location. The replacement will be shipped to the hardware's physical address listed in your User Center, which we will confirm with you when you open the support request.
Advanced Hardware Replacement:
To get a replacement shipped to you beforeyou return the faulty unit, you must have an active support plan that includes this service. Options like Standard Onsite, Premium, and Premium Onsite include Advanced Replacement to minimize your downtime.

ADDITIONAL RESPONSIBILITIES
You agree:
- Before TIBURN or its partner exchanges a Hardware Product or part, to remove all features, parts, options, alterations, data and attachments not under warranty service and ensure that the Hardware Product is free of any legal obligations or restrictions that prevent its exchange.
- To obtain authorization from the owner to have TIBURN or its partner service a Hardware Product that you do not own.
- Where applicable, before service is provided:3.1 Follow the service request procedures that TIBURN or its partner provides;3.2 Backup and secure all programs and data in the Hardware Product;3.3 Inform TIBURN or its partner of changes in the Hardware Product physical location.
- To provide TIBURN or its partner with sufficient and safe access to your facilities to permit TIBURN to fulfill its obligations.
- To ship back the faulty Hardware Product (or replaceable unit) suitably packaged according to the guidelines as TIBURN specified in the letter shipped with the RMA, to the TIBURN designated location.
- You shall ship the faulty Hardware Product once TAC approves the RMA and provide the courier name and tracking number to TAC before TIBURN processes the RMA.
- If you are a customer who has purchased the support plan with TIBURN covering Advanced Replacement Service, You will ship the faulty Hardware Product within five (5) business days of the arrival of the RMA, or pay the standard TIBURN list price of replacement Hardware Product.
- To securely erase from any Hardware Product you return to TIBURN for any reason all programs and data not provided by TIBURN with the Hardware Product. You acknowledge that in order to perform its responsibilities under this Limited Hardware Warranty, TIBURN may ship all or part of the Hardware Product or its software to third party locations around the world, and you authorize TIBURN to do so.
LIMITATION OF LIABILITY
This section limits our liability to you. It is an important part of our agreement.
Notwithstanding anything else in this agreement, Tiburn and its suppliers will not be liable for:
- Indirect, special, incidental, consequential, or punitive damages; or
- Lost data, lost profits, or the cost of obtaining replacement goods or services.
This limitation applies regardless of the legal theory (such as contract, negligence, or strict liability) and even if we have been advised that such damages might occur.
For any claim related to an error, defect, or problem with a product or service, our total liability will not exceed the price you paid for the specific defective product or service.
For all other claims not related to a product defect, our total cumulative liability to you will not exceed the total amount you paid to Tiburn under this agreement in the three (3) months immediately before the event giving rise to the claim.
GOVERNMENT REGULATION AND EXPORT CONTROL
When you use Tiburn's Limited Hardware Warranty service, you agree to comply with all applicable export control laws and regulations. This means you cannot ship, transfer, or export the hardware product to any prohibited country, or use it in any way that violates these laws.
Please note that Tiburn's hardware products are subject to export control laws of the United States and potentially other countries. These restrictions apply to both you and the jurisdiction where you are located.
Specifically, when a Tiburn product enters the United States, it becomes subject to regulation by U.S. government agencies including the Department of Commerce. These regulations prohibit the export or diversion of certain products and technologies to certain countries.
Your obligations regarding the hardware product are always subject to U.S. laws and regulations governing technology exports, including the Export Administration Regulations (EAR). You are responsible for ensuring your compliance with all applicable export and re-export restrictions that may be in effect.
By using Tiburn's products and warranty services, you confirm that you will comply with all applicable export control requirements.
